In a unique request, a grandmother urged the Hyderabad High Court to accept her plea to demote her grandson from class II to I since he is allegedly unable to cope with the syllabus and requirements of the class. Her petition, which was earlier dismissed by a single judge, states that her grandson cannot cope academically to the standards of class II and thus must be 'downgraded'.

Making it clear that the court would not be concerned with legal niceties while dealing with cases pertaining to the child's rights and their future, a division bench of the Hyderabad High Court on Thursday directed the management of Hyderabad Public School to respond.

The bench comprising Acting Chief Justice Ramesh Ranganathan and Justice M Ganga Rao was dealing with an appeal filed by the grandmother of the student, K Advetya, seeking direction to the school management to demote the student from class two to one. While dealing with the appeal, the bench wondered how the management could admit a student in class 2 if he could not cope with the class he was admitted into.

The counsel for school pointed out that the child's admission into class 2 was based on an application. A candidate cannot be permitted to choose the class to which he or she has to be sent, he noted. The bench has adjourned the case till Monday to enable the school management to respond.
